Ratio: Whilst there is no absolute rule of law requiring a delay in a road traffic case involving death pending the results of a coroner’s inquest, in practice they should do so, and make appropriate enquiries as to the stage reached by the inquest. Nevertheless, in this case, being unaware of the true position and having proceeded in ignorance of it, the trial decision must stand.
